Rosebud Mining Company is requesting bond releases for the following areas in Carroll County on which the reclamation has been completed in accordance with the approved reclamation plans:

 

D-2229 (issued 12/29/2004) Sec 26, Rose Twp. Phase 3 Year 3, 43.8 acres,

seeding completed 6/18/09, $16,425.00 on deposit and to be released. Phase 3 Year 4, 31.9 acres, seeding completed 9/10/10, $11,962.50 on deposit, and to be released. Phase 3 Year 5, 9.8 acres, seeding completed 9/10/10 $3,675.00 on deposit, and to be released. Phase 3 Year 6, 54.3 acres, seeding completed 4/20/11 $20,362.50 on deposit, and to be released.

 

Written objections or requests for a bond release conference may be submitted to the Chief of the Division of Mineral Resources Management, Attention: Tammie Heller, Building H-3, 2045 Morse Road, Columbus, OH 43229-6693, in accordance with paragraph (F)(6) of Revised Code Section 1513.16. Written objections or requests for bond release conferences must be filed with the Chief within 30 days after the last date of this publication.

Hall aka Stanley Ray Hall will take notice that the Plaintiff, KeyBank National Association, filed its Complaint in the Court of Common Pleas, Carroll County, Ohio, with the above referenced case number. The object of, and demand for relief in the Complaint is, to foreclose upon the Plaintiff’s Mortgage recorded upon the real estate described below and in which the Plaintiff alleges that the foregoing Defendants have or claim to have an interest:

Situated in the Township of Perry, County of Carroll, and State of Ohio:

Being a part of the Northwest Quarter of Section (29), Township (12), Range (5) of the Old Seven Ranges and further being a part of a tract of land heretofore conveyed to Brenda L. Dramble, Stanley R. Hall & Allen E. Warfield by Warranty Deed, and described as 10.386 acres in Deed Volume (234), Page (533) of the Carroll County Deed Records; said tract of land, herein intended to be conveyed, being more particularly described as follows:

Commencing, for reference, at a marked stone, (found), at the Northwest corner of Section (29);

Thence South 5 degrees 12’ 10” West, along the West line of the Northwest Quarter, a distance of 239.39’ to a 5/8” iron bar, (set); said point being the Northwest corner true place of beginning of the herein described tract;

Thence leaving the Section line, South 84 degrees 37’ 24” East, along a new line of division within the Grantor’s lands (D.V. 234, Page 533), a distance of 662.16’ to a 5/8” iron bar, (set); in the Westerly bound of lands of J. & D. Hendricks (D.V. 233, Page 470); passing over a 5/8” iron bar, (set), for reference, at 72.00’;

Thence South 5 degrees 21’ 04” West, along said Westerly bounds, a distance of 211.19’ to a 5/8” iron bar, (set);

Thence North 84 degrees 37’ 24” West, along a new line of division within the Grantors’ land (D.V. 234, Page 533), a distance of 661.61’ to a 5/8” iron bar, (set), in the West line of the Northwest Quarter of Section (29); (passing over a 5/8” iron bar, (set), for reference, at 621.61’);

Thence North 5 degrees 12’ 10” East, along the West line of the Northwest Quarter, a distance of 211.19’ to the true place of beginning; said described tract containing 3.209 acres.

Subject to all legal highways and any easements or reservations of record.

This Legal Description is intended to define a part of the property of Dramble, Hall & Warfield as located in Section (29), Township (12), of Range (5) and formerly described as encompassing 10.386 acres in Deed Volume (234), Page (533). This tract of land has been found, by resurvey, to contain 9.987 acres. The partition tract, herein described, contains 3.209 acres.

The bearing system contained herein was established from an orientation to make the West line of the Northwest Quarter of Section (29), and the bearing of “North 05 degrees 12’10” East” was assumed for this line pursuant to a survey prepared by D. Bodo and recorded in Survey Filed #5023 of the Carroll County Survey Records.

The above description prepared from a survey performed by R.J. Swearingen, Ohio Registered Surveyor #7162, in April, 1999.
