A pre-trial hearing has been set for Feb. 18 in Carroll County Municipal Court for James V. Bates of 3022 Carey Rd., Salem, a former part-time village administrator and water superintendent for the village of Malvern.
According to a complaint filed Oct.9, 2015, by the village of Malvern, Bates owes the village of Malvern $12,329 as reimbursement for monies for overpayment of Bates’ share of his required contribution to the Public Employee Retirement System.
In a separate complaint filed Oct. 9, 2015, James Cinson of 9191 Latin Rd., East Canton, a full-time superintendent of village services for the village of Malvern, is being sued by the village of Malvern seeking judgment in the amount of $55.68 for recovery of monies overpaid to the defendant for his wife’s insurance deductible in the amount of $812 when Cinson failed to pay the sum of $55.68 towards his contribution of the annual premium due in 2013. The case is still pending in Municipal Court.
The Court action against the two former village employees came about when the state auditor released findings for recovery last June against the village for a total of over $15,000.
