The plaintiff demands that the defendants named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshaling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of plaintiff’s claim in the proper order of its priority and for such other and further relief as is just and equitable.

PUBLIC NOTICE FOR SURFACE AND UNDERGROUND COAL MINING & RECLAMATION PERMIT APPLICATION

 

Rosebud Mining Company, 95 North Lisbon Street, Carrollton, Ohio 44615 has submitted an Application to Revise a Permit (ARP), application number   R-2397-6   to the Ohio Department of Natural Resources, Division of Mineral Resources Management.   This application is for the DM-16 Mine and the surface permit area is located in Carroll County, Rose Township, 21 & 22 Sections, Township 16 North, Range 7 West on the properties of Lindentree Industrial Corp, R.S. & D.L. Collins and F.J. and M.E. Suskey. The surface permit area contains 45.4 surface acres and is located on the Dellroy, Malvern, & Mineral City 7 1/2 Minute U.S.G.S. Quadrangle Maps approximately 4 miles South of Magnolia, Ohio.

 

The purpose of this permit revision is to change the post mining land use on 2.9 acres of the surface permit area from grazing land to Industrial. The change of the post-mining land use will only occur on the surface property owned by Lindentree Industrial Corp. No further underground mining will occur on this permit. On site reclamation will continue on this permit until completed and will be done in accordance with the currently approved reclamation plan for Permit D-2397.

 

The application is on file at the Carroll County Recorder’s Office, Carroll County Courthouse 119 Public Square, Carrollton, Ohio 44615 for public viewing.

 

Written comments or requests for an informal conference may be sent to the Division of Mineral Resources Management 2045 Morse Road, Building H-3, Columbus, Ohio 43229 within thirty (30) days after the last date of publication of this notice.
